TERMS OF USE 
These Boomer’s Sports Book Terms of Use are an agreement between Boomer’s Sports Book LLC, a Nevada limited liability company (“Boomer’s Sports Book”, “we”, or “us”), and you (a “User”, “you”, or “your”). These Boomer’s Sports Book Terms of Use apply to your use of and engagement with the Boomer’s Sports Book website available at https://betiwthboomer.com/ (the “Website”), the Boomer’s Sports Book application will be available for download on Android and iOS (together with the Website, the “Boomer’s Sports Book App”), and your use of any services provided through the Boomer’s Sports Book App, including all wagering (collectively, the “Services”).  

These Boomer’s Sports Book Terms of Use are supplemented by the Boomer’s Sports Book Privacy Policy (together, the “Boomer’s Sports Book Policies ”), the Boomer’s Sports Book Wagering Account Rules will be available at https://betwithboomer.com/rules/ (the “Rules”), and any house, promotional, or event rules that apply to your use of any Services or any of your accounts (collectively, these Boomer’s Sports Book Terms of Use, the Boomer’s Sports Book Policies, the Rules, and any house, promotional, or event rules that apply are referred to herein as the “Boomer’s Sports Book Terms”).   

By accessing the Website, downloading the Boomer’s Sports Book App, creating an account, or otherwise engaging with our Services, you agree to read, comply with, and be legally bound by these Boomer’s Sports Book Terms.  

AGE RESTRICTION 
All people under 21 years of age are prohibited from using the Services. If you are younger than 21 years of age, you may not access or use the Services; open an account (including a Boomer’s Sports Book Wagering Account); and/or submit information to the Services. 

BOOMER’S SPORTS BOOK WAGERING ACCOUNT 
To use the Boomer’s Sports Book App, you will need to open a Boomer’s Sports Book wagering account (a “Boomer’s Sports Book Wagering Account”). Your Boomer’s Sports Book Wagering Account is subject to the following terms and conditions: 

• To open a Boomer’s Sports Book Wagering Account, you must complete a Boomer’s Sports Book Wagering Account application in person at a Participating Property. With your Boomer’s Sports Book Wagering Account application, you must submit an acceptable and valid proof of identification, proof of residence, social security number, and other information as required by Boomer’s Sports Book. The individual named on the Boomer’s Sports Book Wagering Account application is the “Wagering Account Holder” and is the only individual entitled to transact using such Boomer’s Sports Book Wagering Account. 
• All Boomer’s Sports Book Wagering Account applicants must be 21 years of age or older. 
• Participating properties include Ellis Island Casino and Brewery, Casino Valle Verde, and Commercial Casino (the “Participating Properties”). Visit www.betwithboomer.com for a list of currently participating properties. 
• For more information about opening a Boomer’s Sports Book Wagering Account, the Rules will be available at https://betwithboomer.com/rules/  
• You may close your Boomer’s Sports Book Wagering Account by visiting a sports book location at any Participating Property. 

LICENSE 
Boomer’s Sports Book hereby grants you a personal, non-exclusive, non-transferable, non-commercial, revocable, and terminable at Boomer’s Sports Book’s sole discretion, license to use (with no right to sublicense) the Boomer’s Sports Book App (and any updates thereto, as Boomer’s Sports Book may provide in its sole discretion) for your personal use on one wireless device associated with your Boomer’s Sports Book Wagering Account. You may not copy, rent, lease, lend, sell, redistribute, or sublicense the Boomer’s Sports Book App. Any attempt to do so is a violation and breach of these Boomer’s Sports Book Terms. 

LIMITATION ON USE 
The Boomer’s Sports Book App is a mobile wagering application available only for use in the State of Nevada. Boomer’s Sports Book does not charge for use of the Boomer’s Sports Book App; however, MESSAGE AND DATA RATES MAY APPLY. Once we verify the information in your Boomer’s Sports Book Wagering Account application and you open and fund your Boomer’s Sports Book Wagering Account, Boomer’s Sports Book will give you instructions on how to download Boomer’s Sports Book App for your wireless device from the Apple or Android app stores. Afterward, you will be able to wager on sporting events using the Boomer’s Sports Book App on your mobile device or desktop, provided you place your wager from within the borders of the State of Nevada. Nevada law prohibits wagers originating from outside the State of Nevada. It is illegal to place a wager originating outside the State of Nevada using our Services. 

BOOMER’S SPORTS BOOK WAGERING ACCOUNT TRANSACTIONS 
All Boomer’s Sports Book Wagering Account transactions, including deposits and withdrawals, must be made by the Wagering Account Holder only. Agents or other representatives are not permitted to transact using a Boomer’s Sports Book Wagering Account for which they are not the Wagering Account Holder. Deposits and withdrawals into a Wagering Account may be made either in person (and signed and authorized by the Wagering Account Holder at a Participating Property) or via an authorized prepaid card. Boomer’s Sports Book Wagering Account transactions are subject to the following limitations and restrictions: 

• Ways to fund your Wagering Account are to be determined.  
• Wagering Account Holders may be required to provide account number and acceptable valid identification when conducting Boomer’s Sports Book Wagering Account transactions. 
• A Boomer’s Sports Book wager will not be accepted if the total value of the wager exceeds the Boomer’s Sports Book Wagering Account balance. 
• Boomer’s Sports Book wagers will be deducted directly from the Wagering Account Holder’s Boomer’s Sports Book Wagering Account balance. Winnings from wagers will be credited directly to the Wagering Account Holder’s Boomer’s Sports Book Wagering Account. 
• Boomer’s Sports Book wagers are subject to established wagering limits. The minimum wager is to be determined. 
• Boomer’s Sports Book wagers are accepted during Boomer’s Sports Book hours of operation, unless Boomer’s Sports Book determines otherwise in its sole discretion. 
• Winning tickets subject to IRS reporting and/or withholding will not be posted to the applicable Boomer’s Sports Book Wagering Account until all information has been verified and proper signatures are obtained in person. All applicable taxes are the responsibility of the Wagering Account Holder. 
• The Boomer’s Sports Book Terms are subject to change by Boomer’s Sports Book at any time, including as the result of regulatory review. Please visit our Website at www.www.betwithboomer.com and review the Rules regularly to learn of any changes. We may update or change the Rules and/or these Boomer’s Sports Book Terms (and all rules, policies, and guidance referenced herein) at any time and in our sole discretion and without advance notice to you. Your continued use of the Services (including your Boomer’s Sports Book Wagering Account) after the posting of any change to Boomer’s Sports Book Terms constitutes your binding acceptance of such change. If any change is unacceptable to you, you must stop using the Services Sports entirely and close your Boomer’s Sports Book Wagering Account. 
• All Boomer’s Sports Book Terms, state and federal laws, and Nevada Gaming Commission (“NGC”) regulations apply to Boomer’s Sports Book Wagering Accounts. 

REPORTING 
Upon request, Boomer’s Sports Book will provide the Wagering Account Holder with a detailed report for such Wagering Account Holder’s Boomer’s Sports Book Wagering Account. The report may include the following information: 

• Account number 
• Beginning balance 
• List of all transactions, including the following information with regard to each transaction: 
• Date and time 
• Amount 
• Type (e.g., deposit, withdrawal) 
• Gaming area, if applicable 
• Employee(s) who authorized the transaction 
• Total by credit and debit 
• Ending balance 

Note: Credit as defined by NGC Regulation 5.225(11) and debit as defined by Regulation 5.225(12). 

DISPUTED TRANSACTIONS
A Wagering Account Holder may dispute any transaction according to NGC Regulation 7A or Title 41 of the 2010 Nevada Code (NRS 463.361-463.366), as applicable. 

For all wagers, Boomer’s Sports Book shall make a voice, print, electronic, or other approved record of the entire transaction and shall not accept any wager if the recording system is inoperable. Boomer’s Sports Book’s record of a Wagering Account Holder’s confirmation of wagers shall be deemed to be the transaction of record. Such records are made available to the Nevada Gaming Control Board (the “NGC Board”) upon request. 

You acknowledge that sports wagers are not deemed accepted until the wager is confirmed through a message from the Boomer’s Sports Book App. You understand and agree that any malfunction of the Boomer’s Sports Book App, or other device or system failure may void all payouts. A Wagering Account Holder shall immediately inform Boomer’s Sports Book in the event the Wagering Account Holder believes any error has occurred related to their Boomer’s Sports Book Wagering Account, a wager, or any other transaction with the Services. Any funds or winnings credited to a Boomer’s Sports Book Wagering Account in error will not be available for use until such error is resolved. 

ACCEPTANCE OF WAGER
You acknowledge that a wager placed using the Boomer’s Sports Book App is binding on you and Boomer’s Sports Book at such time that the Boomer’s Sports Book App displays a request for confirmation and, if you press “Confirm”, the Boomer’s Sports Book App displays a confirmation message, an example of which follows: 

• You acknowledge that once a wager has been accepted by the Boomer’s Sports Book App and displays the confirmation message, the wager is binding on both parties and cannot be modified, cancelled or voided by either party.

BOOMER’S SPORTS BOOK RIGHTS 
Boomer’s Sports Book, in its sole and absolute discretion, has the right to: 

• refuse to establish a Boomer’s Sports Book Wagering Account for what it deems a good and sufficient reason; 
• refuse deposits to Wagering Accounts for what it deems a good and sufficient reason; 
• refuse to accept all or part of any wager for what it deems a good and sufficient reason; 
• declare that any or all wagers will no longer be received; and 
• unless there is a pending NGC Board investigation or Wagering Account Holder dispute, suspend or close any Wagering Account at any time as permitted in the Boomer’s Sports Book Terms; provided, however, when a Wagering Account is closed, Boomer’s Sports Book shall immediately return the balance of the Wagering Account at the time of said action (subject to compliance with NGC regulations, the Boomer’s Sports Book Terms, and federal and state laws and regulations) by sending a check to the Wagering Account Holder’s address of record. 

CONFIDENTIAL BOOMER’S SPORTS BOOK WAGERING ACCOUNT INFORMATION
Except as otherwise expressly provided, Boomer’s Sports Book shall keep confidential the following (collectively, the “Confidential Wagering Account Information”): 

• the amount of money credited to, debited from, or present in any Boomer’s Sports Book Wagering Account;  
• the amount of money wagered by a Wagering Account Holder on any game or gaming device; 
• the account number and secure personal identification method that identifies the Wagering Account Holder; 
• the identities of particular entries on which a Wagering Account Holder is wagering or has wagered; and 
• the name, address, and other information in Boomer’s Sports Book’s possession that would identify the Wagering Account Holder to anyone other than the NGC Board or Boomer’s Sports Book.  

Boomer’s Sports Book will share the Confidential Wagering Account Information only: 

• with the NGC Board; 
• with financial institutions participating in a program established in accordance with Section 314(b) of the USA Patriot Act; and/or 
• as required by state or federal law. 

Boomer’s Sports Book may share the Confidential Wagering Account Information:  

• with any licensed affiliate of Boomer’s Sports Book; 
• with a person who has been issued a nonrestricted license for an establishment where Boomer’s Sports Book or its affiliates operate a race book or sports pool; and/or 
• as authorized by the Wagering Account Holder. 

BOOMER’S SPORTS BOOK WAGERING ACCOUNT SUSPENSION 
In addition to other suspension rights set forth in the Boomer’s Sports Book Terms, Boomer’s Sports Book may suspend a Boomer’s Sports Book Wagering Account if the Boomer’s Sports Book Wagering Account has not been used to make any wagers for 16 consecutive months. A suspended Boomer’s Sports Book Wagering Account may be reactivated by the Wagering Account Holder in person by presenting the Wagering Account Holder’s valid government-issued picture identification credential.
